ASBESTOS POWERHOUSE VERDICT
Weitz & Luxenberg wins $91-million NYC asbestos case

Throughout 1992, there was a series of enormous plaintiffs' verdicts coming out of New York in asbestos-related personal injury cases. The biggest award came in the first damages trial of the so-called New York Powerhouse case.

This involved some 700 men who were exposed to asbestos between the 1920s and the 1970s while working as insulation installers at the powerhouse stations owned by Consolidated Edison and Long Island Lighting Co.

The claims of 47 plaintiffs were tried in Brooklyn this year. The majority of the workers named in the lawsuit were long dead by the time the damages phase came to trial, said lead plaintiffs' counsel Robert J. Gordon. One died as long ago as 1963. These workers, or their families, were able to sue over asbestos exposure when New York state passed its revival statute in 1986, giving these workers one year to file.

On Aug. 15, 1991, at the end of the seven-week trial, a Brooklyn federal jury awarded a total of $91.3 million to 45 plaintiffs. Two plaintiffs were awarded more than $6 million each. This trial determined only the damages; a second trial apportioned liability.
