HOSPITAL MALPRACTICE SETTLEMENT
City agrees to pay $2M for wrongful
death in Brooklyn psychiatric emergency room nightmare
May 28, 2009 – The family of a 49-year-old Brooklyn woman who died last year,
unnoticed, on the floor of the psychiatric emergency room at Kings County
Hospital Center, reached a $2 million settlement in the wrongful death case that shocked the city
last year.
The victim, Esmin Green, 49, waited in the emergency room of the city-run
Kings County Hospital Center for more than 24 hours last June until she fell to
the floor, where a video showed she laid for another hour before hospital
workers noticed her.
Ms. Green, a Jamaican immigrant with six children, worked to support them at
a child’s day care center before losing her job. Suffering from depression, she
sought help at Kings County Hospital Center – the only mental health provider
for poor people in Brooklyn. The medical examiner said her death was caused by
blood clots that moved from her legs to her lungs.
