Asbestos lawsuit filed against DuPont, et al
November 4, 2009 - Mr. Lively Neely worked at the DuPont plant in Old Hickory, Tenn., for two decades. And for two decades, he brought home on his work clothes deadly asbestos dust. Those asbestos-covered work clothes were always hand washed by his wife, Mrs. Ruby Neely.
The couple's son has filed a mesothelioma lawsuit against DuPont and 20 others that subcontracted at the plant during his father's 20-year period of employment.
Mrs. Neely died this year of mesothelioma, a cancer caused by job-related exposure to asbestos. Mesothelioma can also be contracted through secondhand household exposure, as in this case.
The lawsuit alleges that DuPont failed to warn its employees of the dangers of wearing work clothes out of the plant, and that that failure contributed to the death of his mother.
Second DuPont lawsuit filed over asbestos
Mr. Neely, Sr.’s job involved cutting, molding and fitting asbestos-containing insulation and cement onto the various lines at DuPont. Mr. Neely also died of asbestos-related disease, and had settled a lawsuit with the company in the 1980s.
According to the son’s current lawsuit, DuPont allowed workers to go home with asbestos on their work clothes, and didn't provide a change of clothing or showers to prevent asbestos exposure at home.
Tennessee Supreme Court rules
The Tennessee Supreme Court last year ruled in a similar case in which Amanda Satterfield sued Alcoa claiming she was terminally ill from the asbestos dust her father carried home from work.
Though the case was initially dismissed, Tennessee’s highest court disagreed and sent the case back for trial. That case was reportedly settled for a confidential amount.
Time to seek justice
Government health agencies estimate that in the next decade more than 35,000 people nationwide will be diagnosed with the deadliest form of asbestos-related cancer, mesothelioma.
