Consider an environmental lawsuit if the Kingston Fossil Plant spill caused property damage or illness.

A barrier that kept sludge contained at the Kingston Fossil Coal Plant in Tennessee has failed, spilling millions of gallons of waste, reported the CNN cable network on December 23. Some residents are considering an environmental lawsuit.

The Environmental Protection Agency expects the cleanup of the waste to take over a month.

The waste material--comprised of ash from the plant's coal--broke through its contained area at the Tennessee Valley Authority's power plant in Kingston, about 40 miles east of Knoxville, CNN said.

Reportedly, the sludge from the Kingston Fossil Plant damaged over a dozen homes, required a mass evacuation of residents, and resulted in three houses being determined to be uninhabitable.

According to the news report, the Kingston Fossil Plant sits on a tributary of the Tennessee River called the Clinch River.

Residents are now worried that more sludge will enter the water supply.

As one of the nation’s leading plaintiffs’ law firms, Weitz & Luxenberg can provide you with the legal strength you need to take on companies that have polluted your community with dangerous chemicals.

The firm recently secured a landmark settlement against some of the country's biggest oil companies for contaminating public drinking water supplies with a gasoline additive known as methyl butyl tertiary ether, or MTBE. Most of those defendants agreed to pay $423 million to settle suits involving the contamination of 153 public and private drinking water systems nationally.

Weitz & Luxenberg has been winning such cases for over 20 years.
