Newborn babies injured at birth by medical malpractice

In 2009 Buscone successfully sued the hospital where she was born, Bellevue Maternity Hospital in Niskayuna, NY. She was awarded $43.5 million. The law firm that represented her, O'Connell and Aronowitz said that it was the largest personal injury verdict in the history of the upstate New York area. The awarded compensation will go to pay for home health aides, past and future pain and suffering, and the balance for medical expenses and loss of earnings. “Busone will always require the use of a wheelchair, care of home health aides and medical equipment, and will never be able to work to support herself financially,” said the law firm. One of her attorney’s, Stephen Coffey, noted that the verdict confirmed that Bellevue didn’t do what it was supposed to do when Buscone was born in 1984.
Denise Cisnero, the woman whose daughter was also injured for life by medical malpractice during birth, successfully sued Advocate Lutheran General Hospital in 2010. She received a $6.5 million settlement.
“(The child) will obviously never work and needs 24-hour care,” said her lawyer. “She’ll never be able to live independently and this money will be utilized to take care of her for the rest of her life.”
