Mercury Reduction Rules in New Jersey Cause a Stir

October 11, 2006

The New Jersey Department of Environmental Protection's proposed regulations regarding the reduction of New Jersey's mercury emissions have been approved by the Appellate Division of the Superior Court of New Jersey.

These regulations are geared towards the recution of mercury emissions from four main sources:

  • Coal-burning power plants
  • Municipal solid waste incinerators
  • Medical waste incinerators
  • Iron and steel melters


  • The regulations will achieve an estimated 85 percent reduction of overall mercury emissions in New Jersey.

    The EPA's proposals were challenged by the affected industrial entities i.e. a national association representing iron and steel melters and the owner of two New Jersey facilities. They claimed that the requirements were too "stringent." The court held that the state had acted well-within its “broad authority to issue health-based regulations.”
