$7.3 M Verdict Secured for Child’s Undiagnosed Meningitis by New York Attorneys
August 28, 2009
The family of a young girl afflicted by meningitis can have some peace of mind after a $7.3 million verdict was secured for them by lawyers from Weitz and Luxenberg, a firm based in New York. The Neonatal Intensive Care Unit at the Cedar Sinai Medical Center in Los Angeles has been found guilty of medical negligence for failing to promptly diagnose the child’s illness and treat it appropriately at her birth.
Tragically, because the Meningitis was left untreated for five years, the child has severe, irreversible brain damage. The senseless suffering she and her loved ones must endure could have been avoided if the medical professionals on staff had been more attentive. In addition to the great difficultly of raising a child with special needs, the parents have to worry about paying for the exorbitant medical treatments that the child will require for the rest of her life. The $7.3 million is in a trust fund for the child’s medical care, but that money can only ease some of the financial burden.
Meningitis, an inflammation of the membranes that cover the brain and spinal cord, is a serious infection that can be highly contagious. Infants or very young children afflicted with the illness may vomit frequently, have low energy and be more irritable than the average child (Center for Disease Control and Prevention). The little girl who now has brain damage as a result of undiagnosed Meningitis could have been spared her health troubles with early diagnosis and treatment.
