June 17, 2009 - Medical device maker Synthes Inc., its subsidiary Norian Corp., and four company executives were indicted on federal charges that they promoted a bone cement product –Norian SRS and its successor, Norian XR – and conducted unauthorized human trials involving spinal procedures without the approval of the Food and Drug Administration (FDA).
“They put their profits ahead of responsible business practices and the truth,” Michael L. Levy, the United States attorney, said in a statement.

Prosecutors charged Synthes with unauthorized marketing of Norian XR after learning from pilot studies that the bone cement product reacted chemically with human blood to cause blood clots.
Despite this knowledge, prosecutors said the company proceeded to market Norian XR for vertebral-compression fractures, and didn’t stop after three patients died on the operating table from a rapid drop in blood pressure. Federal prosecutors said they could not prove yet that the Norian products caused the deaths.
Prosecutors estimated that 200 patients had the improper operations. Norian faces possible fines of $28 million, while Synthes, its parent, faces fines of $8 million.
