The Michigan Department of Environmental Quality issues report on groundwater contamination in Paw Paw

Paw Paw, Michigan, real estate news.

April 26, 2010 – Eighty residents and former residents of Paw Paw, Michigan, whose homes and real estate were damaged by decades of chemical soil contamination from a local soft drink bottling plant, today filed a property damage lawsuit against The Coca-Cola Company seeking restitution.

Their law firm, Weitz & Luxenberg, filed court papers today in the Circuit Court for the County of Van Buren. The plaintiffs charge Coca-Cola with contamination of Paw Paw's drinking water and home real estate properties with chemical pollutants emitted from the company’s Minute Maid bottling plant on Red Arrow Highway.

The Michigan Department of Environmental Quality, which fined Coca-Cola $50,000 for over-saturating its spraying fields 10 years ago, has issued a Frequently Asked Questions report on the groundwater situation in Paw Paw.

Paw Paw residents are seeking restitution for the ground water contamination, which has had a severe impact on home real estate values. The town’s assessor reportedly notified affected residents that the toxic chemical spill has reduced their homes’ “state equalized values” by at least 10 percent, making future home sales very difficult.

Coca-Cola reportedly sprayed waste water onto spraying fields for more than 30 years, according to the seven-count complaint. Groundwater tests show dangerous levels of heavy cancer-causing metals, including arsenic, iron and manganese.

Community members have reported health problems related to the toxic contaminant spill, including gastrointestinal, kidney and central nervous system disorders.

According to the report published by the Michigan Department of Environmental Quality, symptoms associated with heavy metal poisoning are as follows:

ARSENIC

  • Thickening and discoloration of the skin
  • Skin cancer
  • Stomach pain, nausea, vomiting and diarrhea
  • Numbness in the hands and feet.

    IRON

  • Rusty, foul-smelling water
  • Bacteria growth
  • Excessive iron intake.

    MANGANESE

  • Discolored, foul-tasting water
  • Central nervous system disorders
  • Behavioral changes.
