PAW PAW LAWSUIT
Brockovich group organizes action against Coca-Cola

Home owners in Paw Paw, Mich. asked environmental crusader Erin Brockovich for lawsuit guidance on how to correct Paw Paw's well water contamination problem caused by a local Coca-Cola bottling plant.

Brockovich, with her chief environmental investigator, Robert Bowcock, organized a town meeting at Paw Paw High School to tell residents that the Brockovich group had already begun representing property owners through the New York-based law firm that she trusts and works with regularly, Weitz & Luxenberg, P.C.

Soil contamination has already affected more than two dozen properties, primarily those situated near the source of the contamination – Coca-Cola’s Minute Maid plant on Red Arrow Highway. Paw Paw is a village with a population of approximately 3,400 residents located on Interstate 94, approximately 20 miles west of Kalamazoo.

Paw Paw lawsuit

Bowcock said residents experiencing well water contamination are already organizing a lawsuit against Coca-Cola North America. Normally a case like this takes time, he said, because settlements aren't generally made until the middle or end of a lawsuit.

However, a settlement could come sooner, he said, because Coca-Cola had already made a good-faith overture to some residents by offering to hook them up to the village water system.

The town’s soil contamination is attributed to the spraying of juice waste on fields located behind the Paw Paw facility. Juice waste sprayed on fields can strip metals from the soil and make them soluble in groundwater.

Recent soil tests show detectable levels of arsenic, lead, iron and manganese. Village authorities in Paw Paw are advising residents to drink bottled water.
