Deceased worker’s family receives $3.4M in case of occupational asbestos exposure

July 28, 2009 – The family of a former Johns-Manville worker, who died of mesothelioma caused by occupational asbestos exposure, received $3.4 million last week from a San Francisco jury.

The jury deliberated just one day before agreeing with the plaintiffs’ allegations that asbestos caused the family breadwinner’s death.

According to the lawsuit, Advocate Mines Limited, an asbestos mining firm located in Baie Verte, Newfoundland, was negligent in failing to warn employees about the hazards associated with asbestos, a toxic mineral known to cause mesothelioma, asbestos lung cancer and asbestosis.

San Francisco Verdict: Asbestos killed devoted worker

Advocate Mines Limited supplied asbestos to the Johns-Manville plant where the deceased worked from 1968 to 1984. His career with Johns-Manville began in Waukegan, Ill., where he worked as a painter, then a planner and finally as a millwright.

During his time at the Johns-Manville plant, the deceased was exposed to asbestos dust used to make transite asbestos-cement pipe. Throughout the workday, he cleaned and repaired transite manufacturing equipment and dust collection equipment, including bag houses, ventilators and cyclones.

Evidence was presented to demonstrate that by 1963 medicine and science proved that asbestos exposure causes serious illnesses, yet Advocate Mines Limited continued to supply asbestos fiber without warnings of potential health hazards.

The negligence on behalf of the company and the failure to warn of the danger associated with asbestos spurred the jury to award $877,750 in economic damages and $2.5 million in non-economic damages to the surviving family members.
