Weitz & Luxenberg Addresses Horrific Odor in Stark County, Ohio.

January 14, 2007, New York, NY--Concern is escalating over the terrible odor that is keeping people from enjoying daily life in Bolivar and surrounding communities in Stark County, Ohio.

The Environmental Protection Agency has linked the foul air to increased activity at the landfill Countywide Recycling & Disposal Facility.

“It’s outrageous that people living and working around this landfill for years have been and are still being exposed to noxious odors by the operators of this landfill,” stated Robin Greenwald, Head of the firm’s Environmental Toxic Torts Unit of Weitz & Luxenberg, P.C.

Bill Skowronski, chief of the Environmental Protection Agency’s office in Twinsburg, Ohio, is reported in the Beacon Journal as stating that the odor complaints in Pike Township, where the facility is located, climbed from 46 in October to 82 in December.

The smell is said to be caused by aluminum dross/saltcake, which Countywide once accepted in large amounts. The Times-Reporter quoted Richard Regula, head of Stark County’s waste management board, as saying that Countywide accepted between 200,000 and 300,000 tons of the material when Barmet Aluminum at Uhrichsville was cleaned up.

Regula asked, “Shouldn’t the landfill have known? Weren’t they aware of that product just sitting on the ground was not hazardous but when mixed with water it was?” Regula is not alone in wondering about the odor and how it will affect local residents.
