Synthes’ bone cement products – Norian SRS and its successor, Norian XR – lack FDA approval for use on spinal fractures and could lead to serious complications, even death. June 18, 2009 - Medical device maker Synthes Inc., its subsidiary Norian Corp., and four company executives were indicted two days ago on federal charges that they marketed a bone cement product (Norian SRS and its successor, Norian XR) and conducted clinical human trials without authorization from the U.S. Food and Drug Administration (FDA). Three family dependents of people serving in the military reportedly died during surgery.
“The Department of Defense is outraged by a company that potentially puts our military personnel, their family members, and veterans at undue risk for serious medical complications or even death, just to increase their corporate bottom line,” Assistant Special Agent-in-Charge Kenneth Maupin, of the Defense Criminal Investigative Service said in a statement.
The U.S. Department of Veterans Affairs is involved in the investigation because “some of the procedures were at VA hospitals,” said a spokeswoman for the U.S. Attorney in Philadelphia. Officials aren’t releasing the names of the hospitals, she said.
Prosecutors estimate that 200 patients had the improper operations.
Synthes, Inc. is a $3 billion global company specializing in trauma products and devices to treat damaged bone. Norian faces possible fines of $28 million, while Synthes, its parent, faces fines of $8 million.
