FDA warns Topamax users of birth defects but does not recall drug

Topamax is prescribed for seizure disorders, migraines, and a few off-label uses, but new evidence shows that the drug increases the risk of birth defects. The FDA has warned the public about this and placed Topamax into the drug category “Pregnancy D”. This category is to show that these drugs may not be suitable for pregnant women or women looking to become pregnant. As of May, 2011, the FDA shows no signs to recall the drug; however, the director of FDA’s Division of Neurology Products said that “health care professionals should carefully consider the benefits and risks of topiramate [Topamax] when prescribing it to women of childbearing age.”

Weitz & Luxenberg takes the stance that any risk of birth defects is too high. We want to help those such as yourself who gave birth to a child with either a cleft lip or palate caused by Topamax use. Cleft palates or lips often require extensive medical treatment. You need not foot the bill yourself – Weitz & Luxenberg can help you pursue the compensation needed to cover all medical expenses. We have been helping individuals with similar cases to yours for over twenty years. Contact us today for a free consultation.

What is the risk?

On March 4th, 2011, the FDA issued a warning concerning the risks of birth defects associated with Topamax. Topamax (known in the generic as topiramate) is typically prescribed for seizures and migraines, but the FDA has stated that there are “alternative medications that have a lower risk of birth defects [which] should be considered [as a replacement to Topamax for women of childbearing age].”

Topamax’s exact increase in risk of giving birth to a child with a cleft palate or lip is 1.4%, as opposed to a normal risk of .07% (FDA).

Why has no recall been issued?

Weitz & Luxenberg does not know why no recall has been issued for Topamax, but regardless, you still have the right to pursue financial compensation from the injuries this drug has caused.

What can Weitz & Luxenberg do?

Weitz & Luxenberg has a skilled team of attorneys specializing in defective medication ready to fight on your side for the compensation you deserve. A child with a cleft palate or lip needs medical care, dental care, and sometimes speech therapy. Insurance does not always cover everything you need, and there is no reason why you should have to pay the rest. Let those responsible compensate you and your child.

Compensation through a lawsuit can cover the following and more:

  • Medical bills
  • Surgery costs
  • Medication (if needed)
  • Hospital stays
  • Prosthetic devices
  • Dental procedures
  • Speech therapy and counseling
  • General pain and suffering
