October 16, 2009 – A 34-year-old history teacher in Grafton, Ohio, said she developed blood clots in both her lungs in 2007 and lost partial use of her right lung after taking birth control pills marketed under the name “Yaz.”
She had used a variety of different birth control pills for more than a decade before switching to Yaz pills in 2007, when she began experiencing Yaz side effects.
“To be perfectly honest, I asked my doctor about Yaz because I had seen the commercial and it mentioned helping control your period symptoms and acne, which was very attractive to me,” she said. “I didn’t think it was going to be worse than any other pill.”
The Bayer franchise had worldwide sales of about $1.8 billion last year thanks to multimillion-dollar ad campaigns that promoted the lower estrogen levels in Yaz, as well as its secondary abilities to reduce premenstrual depression and acne in women under 35.
Yaz pills spur lawsuits
After taking Yaz birth control pills, many women around the country have experienced life-threatening pulmonary embolisms but are unaware they have a right to seek monetary compensation by filing a claim against Bayer.
To date, the manufacturer, Bayer HealthCare, has been served with 74 lawsuits brought by women who say they developed health problems after taking Yaz or Yasmin pills.
FDA warns manufacturer about Yaz pills
Regulators are finding other faults with Yaz pills. The Food and Drug Administration (FDA) early this year asked Bayer to correct misleading television commercials. Last month, the FDA cited the company for not following proper quality control procedures at a plant that makes hormone ingredients.
These FDA warnings raise larger questions about Bayer’s compliance with government rules in general, say plaintiffs’ lawyers, who argue that Bayer has a professional responsibility to know its birth control pills have serious health risks, despite warnings on the label about possible blood clots and strokes.
Some lawsuits argue that women were lured into taking the drug through, what the FDA said were, misleading commercials for Yaz. This advertising strategy ultimately exposed women to health risks they might not have otherwise taken.
