Our firm has represented many individuals who were wrongly denied a life insurance claim and we helped win their lawsuit.
In one case, we represented a man who had obtained an insurance policy many years earlier. At the time, the application asked if he intended to fly non-commercially in the future, and he responded "No."
Years later, however, he did take flying lessons, and problems arose when the insurance broker advised that he could get more coverage for the same premium from another life insurance company.
The broker made the mistake of having a member of his staff copy all of the old applications. By this time, however, the information regarding flying was inaccurate as the insured had begun flying private airplanes. The question about non-commercial flights was again marked "No".
This was a "material misrepresentation," that is, the intentional or negligent concealment of a fact. However, the insured did not look at the policy and application and just signed it and returned it to the broker.
Subsequently, this man died in a private plane crash, and it was within two years of the issuance of the policy. The insurance company denied the claim, claiming a material misrepresentation.
In this particular case, while it was a case of oversight, it was a legitimate material misrepresentation. The insurance company would not have issued him the policy if he had revealed he was a private pilot.
Therefore, the insurance company was dismissed from the case. Instead, the broker was found to have been negligent and we won against him.
