Jury awards retired Illinois man $2 million in asbestos-related mesothelioma lawsuit

August 18, 2009 -- A Springfield, Ill. postal worker and part-time handyman who developed mesothelioma, the deadly cancer long associated with occupational asbestos exposure, filed a mesothelioma lawsuit charging that he contracted the disease from asbestos-containing materials at his job.
After a three-week trial, a Sangamon County, Ill. jury agreed with him and awarded him $2 million.
According to his complaint, the man worked as a U.S. Postal Service employee from 1966 until his retirement in 1992. He testified that he did various odd jobs during the day, including truck driving and home construction and repair.
Now 69 and living in Arkansas, he alleged in his suit that he had used asbestos-containing pipe manufactured by CertainTeed Corp. and asbestos-containing joint compound made by Bondex International Inc. and Georgia-Pacific Corp., among others.
He said the products contained no warnings concerning the asbestos content, and if there were warnings, they were inadequate.
After a three-week trial, the jury found only Bondex International liable and awarded the plaintiff $1.5 million in damages and his wife $500,000 for loss of consortium. It found CertainTeed and Georgia-Pacific not to be negligent. Other defendants either settled with Willis or were dismissed from the case prior to the verdict.
