MassDEP Assesses Penalty for Asbestos Violations in Ludlow, Massachusetts
Asbestos penalty: Ludlow - MassDEP responded to a complaint from tenants living at a building on Highland Avenue in Ludlow, alleging that the landlord, Mr. Artur Paulino, had removed an asbestos insulated boiler from the basement and placed it in a dumpster in the driveway.
MassDEP personnel found the boiler in the dumpster covered with leaves and other debris. MassDEP also found broken asbestos-containing siding in the dumpster. Mr. Paulino, who fully cooperated with MassDEP, was instructed to retain a licensed asbestos consultant to test the apartments for asbestos and to develop a cleanup plan for the dumpster and basement.
Following MassDEP's approval of the cleanup plan, Mr. Paulino hired an asbestos contractor to remediate the site. Mr. Paulino will pay a $10,000 penalty, with an additional $5,000 suspended during a one-year probationary period.
