MassDEP Assesses Penalty for Asbestos Violations in Pittsfield, Massachusetts
Asbestos penalty- Pittsfield - MassDEP responded to a complaint from the Pittsfield Health Department regarding an asbestos boiler and pipes that had been cut out and left in the backyard of a rental property on Clinton Avenue.
During a subsequent inspection, MassDEP personnel observed that asbestos had fallen off the boiler onto the ground, and that the basement was contaminated with asbestos.
The property owners, Robert and Diane Pomeroy, fully cooperated with MassDEP by retaining a licensed asbestos consultant to develop a cleanup plan and hiring an asbestos contractor to clean up the asbestos from both the back yard and the basement. The Pomeroys were assessed a penalty of $25,000, of which $16,000 was suspended during a two-year probationary period.
