October 28, 2009 - A lawsuit filed in Jefferson County District Court in Texas names 84 defendant corporations as contributing to the asbestos-caused diseases of several plaintiffs who charge they were forced to work near asbestos insulation and other asbestos products, without any warnings about the health dangers.
According to the lawsuit: “Even after defendants knew the truth about the propensity of asbestos, they remained mute when by reasonable effort they could have prevented the risk of cancer and asbestosis from afflicting the Plaintiffs.”
The plaintiffs in the case are former craftsmen and construction tradesmen who have worked at refineries and chemical plants throughout Texas.
TEXAS ASBESTOS DEATHS. Texas is the fifth highest-ranking state in the nation for asbestos-related deaths, according to a study by the EWG Action Fund, a non-profit environmental research group headquartered in Washington, D.C.
On the organization’s list of the Top 100 Counties in the United States recording deaths due to asbestos, Texas posted six, including Jefferson County - where the lawsuit was filed!
The six asbestos-plagued counties in Texas are: Jefferson County, Harris County, Dallas County, Bexar County, Tarrant County and Galveston County.
Workers seek restitution
Court papers charge the defendants with failing to instruct workers on how to avoid asbestos exposure, which has caused each to lose their earning capacity. According to the complaint, the asbestos diseases resulted in intense pain, suffering and mental anguish. Those who lost loved ones claim they have lost society and consortium.
Plaintiffs are seeking compensation for either developing an asbestos-related disease or having a loved one pass away from a related condition.
Asbestos and Mesothelioma
Occupational exposure to asbestos is the primary cause of mesothelioma cancer. Mesothelioma symptoms can lay dormant for as long as 50 years, often resulting in a late diagnosis.
