Syracuse, NY Environmental Company Found Guilty of Federal Clean Air Act Violations

In October 2010, a federal jury found the NY-based environmental reporting company, as well as two supervisors at the company guilty of serious air quality reporting violations.  The company, as well as the employees, will be subject to significant fines and other punitive penalties.

On October 13, 2010, the U.S. Environmental Protection Agency (EPA) announced that a federal grand jury had found a Syracuse, NY based environmental services company, as well as two employees of the environmental testing company, guilty of several serious charges relating to violations of the U.S. Clean Air Act.

The company and employees were found guilty of charges related to their alleged failure to properly conduct and submit accurate reports regarding the presence of asbestos at countless renovation and demolition sites throughout the state.  These properties included private residences, schools and commercial buildings.

In addition, the company and the two employees charged in the case were found guilty of alleged mail fraud and alleged conspiracy to defraud the United States.

The two employees face possible fines in excess of $250,000 for each count and possible prison sentences of five years for each count.  They also face additional fines and potential prison sentences of up to 20 years for their role in the mail fraud charge.

Countless Individuals Needlessly Exposed to Asbestos
Tragically, the company’s role in allegedly falsifying lab reports in order to indicate that the properties undergoing renovation or demolition were free of asbestos-containing materials (ACM) caused countless individuals to be exposed to the toxic mineral.

Countless national and international health agencies have all classified asbestos as a known carcinogen (cancer-causing substance).

The time between first exposure to asbestos (known as “latency periods”) and when symptoms of asbestos disease are first noticed is typically 30-40 or more years long.  Because of this decades-long latency period, those that live or work in the buildings where the alleged fraudulent asbestos air testing was conducted now face a lifetime of risk to develop a number of serious asbestos-related diseases.
