Verdict: Employer failed to provide respiratory equipment to foundry workers with asbestosis and colon cancer
In a landmark trial eight years ago, several employees at a foundry won a lawsuit for their asbestos diseases, which included asbestosis and colon cancer.
They were exposed to asbestos in the job, while performing tasks such as cleaning out cupolas by chipping out asbestos residue, mixing refractory cement, and working around ladles and mill rooms where asbestos-containing refractory products were used.
They sued the plant, and claimed it had a duty to make appropriate safety arrangements, such as providing respiratory equipment. They also alleged their employer failed to warn of the dangers associated with asbestos exposure.
This, in turn, imperiled the health of those foundry workers.
