Supreme Court In Wisconsin Rules on Asbestos Insurance Case
In January 2009, the Wisconsin Supreme Court ruled in favor of a Sheboygan-based company in their case against the company’s insurance carrier. Between 1950 and 1983, the company’s Wisconsin plant produced molding compounds that contained asbestos.
The company was facing several hundred lawsuits from individuals who were exposed to their products and had contracted an asbestos-related disease. The insurance carrier argued the new claims were not covered under the company’s coverage.
In a majority decision written by Wisconsin Supreme Court Justice Annette Ziegler, the court said each person injured must be treated as a separate occurrence and the insurance carrier had to pay the full cost of defending and compensating victims up to its policy limits.
