Asbestos insulation worker files lawsuit over lung cancer injury
November 5, 2008 -- A Missouri man who worked as an asbestos insulation installer for 35 years has filed an asbestos-related lawsuit against several companies claiming he developed lung cancer as result of his exposure to asbestos at work.
He and his wife filed their lawsuit on October 20 at Madison County Circuit Court in Illinois. He was diagnosed with lung cancer on June 11, 2008.
Asbestos exposure
They charge the disease was wrongfully caused by his exposure to asbestos during the course of his career as a laborer for the Illinois Central Gulf Railroad between 1947 and 1950, and as an asbestos insulation installer with the Local 90 Asbestos Worker’s Union between 1950 and 1985.
According to the complaint, the man is disabled as a result of having developed lung cancer, and has suffered considerable mental and physical pain. He has been unable to work due to his condition and has also incurred substantial medical expenses.
Time to seek justice!
Despite the serious health problems linked to asbestos exposure, asbestos is still imported and used in the United States. According to the U.S. Geological Survey, the U.S. imported and used an estimated 1,820 tons of asbestos in 2007.
Government sources estimate that in the next decade more than 35,000 people nationwide will be diagnosed with the deadliest form of asbestos-related cancer, mesothelioma. This disease is most often the result of industrial workplace exposure to asbestos – and usually contracted through employers’ blatant disregard for the health and safety of their workers.
That’s why people diagnosed with mesothelioma and their family members have strong cases in court. Weitz & Luxenberg has protected the legal rights of workers for 25 years – longer than most law firms in the nation. And in that time its attorneys have won several billion dollars in verdicts and settlements for its clients.
