To our clients,Recently, in several major newspapers, there have been reports about the formation of a national asbestos trust. This national asbestos trust would potentially put an end to all asbestos lawsuits by creating a fund from which all claimants are paid. According to the New York Times , a national asbestos trust would reduce funds for mesothelioma and lung cancer cases and limit recoveries on non-cancer cases. While this concerns us greatly, at this point, the national asbestos trust is simply a proposal. Much legislation still has to happen before any new asbestos tort law could affect our clients.
In the same New York Times article, senior partner Perry Weitz is quoted as saying, “This [national asbestos trust] is just another avenue to compensate our clients…We represent these people, and our goal is to get them fair and adequate compensation as soon as possible.” If the national asbestos trust does become law, your asbestos claim may still qualify you for compensation, but it will be for a predetermined amount of money, not one determined by a lawsuit.
