NEWS UPDATE:
Project Plan Background: In 1989, EPA finalized the Asbestos Ban and Phase Out Rule, which would have banned all but a few uses of asbestos. Much, but not all, of this ban was reversed by the U.S. Court of Appeals for the Fifth Circuit in 1991.
As a result, in the 1990s, EPA’s asbestos program focused primarily on implementing the Asbestos Hazard Emergency Response Act (AHERA), the Asbestos School Hazard Abatement Act (ASHAA), and the asbestos National Emission Standards for Hazardous Air Pollutants (NESHAP) under the Clean Air Act.
