On June 18, 2009, the U.S. Attorneys office for the Western District of New York announced that charges had been filed against the owner of a Rochester, NY asbestos removal company for violations of the Clean Air Act, submitting false statements and obstruction of justice.

The 15-count indictment states that between June 2006 and August 2008, the man was allegedly responsible for the illegal removal of asbestos at a number of sites in the Rochester area. The man is also charged with allegedly hiding evidence regarding the illegal asbestos removal from federal agencies, including:

  • Failure to provide prior notification to the EPA before the asbestos removal projects were performed;
  • Giving false statements to an Occupational Safety and Health Administration (OSHA) inspector; and
  • Providing a false notification to the EPA.

    If convicted, the man could receive up to five years in prison as well as a criminal fine of up to $250,000 for each count.

    The U.S. Attorneys Office also announced that a public notice will be published in the Rochester Democrat and Chronicle in order to notify potential victims who may have been harmed as a result of the alleged crimes.
