San Francisco, California Developer Fined for Asbestos Violations

In October 2008, the Bay Area Air Quality Management District (BAAQMD) announced they had reached a $515,000 settlement with a San Francisco, California based real estate developer for the company’s failure to monitor and control asbestos dust at a construction site. Exposure to asbestos is known to cause serious diseases such as mesothelioma, asbestos-related lung cancer and asbestosis.
The company was grading a site which will serve as the location of a condominium complex. The site was known to contain asbestos, and the company entered into an asbestos dust mitigation plan with the District to ensure that asbestos dusts would not leave the site.
Though the monitoring was to begin in 2005, the District was not able to confirm the company was following the agreed-upon procedures until 2006. As a result, the company was charged with three violations: failing to maintain air monitoring systems appropriately; failing to maintain wash stations properly and failing to properly contain what they were receiving from those wash stations.
