Asbestos Statutory Requirements

Read the EPA's guidlines and statutory requirements regarding asbestos. Exposure to asbestos is known to cause serious diseases such as mesothelioma, asbestos-related lung cancer and asbestosis.

In implementing these requirements, the Board has noted that, while the regulations do grant the Board de novo review of a penalty determination, in cases where the ALJ assessed a penalty that “falls within the range of penalties provided in the penalty guidelines, the Board will generally not substitute its judgment for that of the [ALJ] absent a showing that the [ALJ] has committed an abuse of discretion or a clear error in assessing the penalty.”
