After Closing a Waste Site that had Asbestos, You Must Update the Site Deed

This information is provided by the Environmental Protection Agency (EPA) and details important information about the need to update the deed for waste sites that contained asbestos.  Exposure to asbestos is known to cause serious diseases such as mesothelioma, asbestos-related lung cancer and asbestosis.

Within 60 days of closing your waste disposal site you must record on the deed to the waste disposal site the following information:

  • The land has been used for the disposal of asbestos-containing waste material
  • The survey plot and record of the location and quantity of asbestos containing waste disposed of within the disposal site have been filed with (name of responsible agency).

    The site is subject to 40 CFR 61 Subpart M.

    In some states, a Notation of Deed form can be used to add this information to a deed, while in others it may be easier to prepare a new deed than it is to annotate an existing deed.

    You should contact the Register of Deeds at the county seat of the county in which your disposal site is located to learn the rules that cover deeds and for instructions on how to proceed.
