Weitz & Luxenberg: a history of favorable outcomes for our clients
For over twenty years, Weitz & Luxenberg has been winning asbestos lawsuits and securing out of court settlements for clients who were exposed to asbestos. Asbestos companies exposed people to their toxic asbestos-containing materials in a variety of settings—many of those settings were a workplace of some sort, but not all.
We have experience helping clients get the asbestos verdicts and settlements they deserve, and the circumstances of their asbestos exposure vary widely. In whatever way negligent asbestos companies exposed you to the tiny, toxic fibers that caused your asbestos-related disease, Weitz & Luxenberg can help you get the compensation you deserve, as we have achieved $3 billion in verdicts and settlements for our clients.
Chrysler made to compensate retired police officer Alfred D'Ulisse $25 million
Alfred D'Ulisse, a retired police officer and former brake specialist, sought compensation from Daimler-Chrysler, for the loss of his right lung to mesothelioma. Chrysler is the fifth largest automaker in the world, and up until their battle with Mr. D'Ulisse, Chrysler had won fourteen asbestos cases in a row.
Chrysler exposed Mr. D'Ulisse and countless others to asbestos with their asbestos-lined brakes. Before joining the police force, Mr. D'Ulisse relined Chrysler brakes at Morak Brakes in Brooklyn, New York, from 1960 to 1981. In November of 2006, the court stated that Daimler-Chrysler had shown “reckless disregard for the safety of others,” and ordered the auto giant to pay 80% of the verdict.
Michael Roberts, Weitz & Luxenberg trial team attorney on Mr. D'Ulisse's case, said, “The jury obviously disbelieved Chrysler’s bogus litigation-defense that working with asbestos brakes is safe.” Somehow, Chrysler managed to beat fourteen cases involving their negligence regarding asbestos. Weitz & Luxenberg lawyers helped Mr. D'Ulisse make sure his case was not number 15.
Jury awards $9.8 million to the family of Dominick Fazio, former electrician
Dominick Fazio was diagnosed with mesothelioma at the age of 71 in 1998, and died of mesothelioma at the age of 72. His widow and grown children sought compensation for Mr. Fazio's death. With the help of Weitz & Luxenberg lawyers, the Fazio family received just compensation for the loss of their father and husband.
Mr. Fazio had inhaled toxic asbestos particles during the more than twenty years he worked with asbestos-containing boilers in power plants throughout New York City. He died within one year of diagnosis. The terrible loss sustained by his wife, children, friends and family does not have a monetary value.
But for the asbestos producers that allowed Mr. Fazio's death an allowable cost of doing business, there should be a price, and Weitz & Luxenberg does all we can to ensure that they rightly compensate the people they have hurt.
Whatever your source of asbestos exposure, Weitz & Luxenberg can help
Mr. Fazio was exposed in power plants. Mr. D'Ulisse was exposed in a brake repair shop. These are only two examples of the ways in which asbestos companies sickened people while they worked. Sometimes the wives and children of men who were exposed to asbestos at work get sick from second-hand exposure—by washing clothes contaminated with asbestos dust, or simply being in the same room.
No matter how you came into contact with it, asbestos is unsafe, and the companies that produced asbestos-containing materials have known this for years. You deserved protection from a substance that “has been declared a proven human carcinogen by the Environmental Protection Agency (EPA) and by the International Agency for Research on Cancer of the World Health Organization.” (Dr. Philip Landrigan, addressing the U.S. Senate in 2005).
But you did not get the protection you deserve. Now that you need medical treatment, or a loved one needs medical treatments because of an asbestos-related disease, you should get the best care you can. Favorable asbestos verdicts and settlements can help you pay for those treatments, and make sure that your family is taken care of, financially.
