Weitz & Luxenberg is known for taking the lead in the prosecution of asbestos cases, having won a landmark consolidated trial in 1991 involving Brooklyn Navy Yard workers in the 1940s and 1950s.
We have handled 36 clients in that case and was awarded $75 million. Another case yielded a $64.65 million award for four asbestos plaintiffs in 1996 (NY, docket # 10893/95), and, in 2002, the firm won a $53 million decision in New York for a brake mechanic diagnosed with mesothelioma (docket No. 12658-00). The trial team has recovered hundreds of millions more for its clients, many of whom formed the core of the triumphant Allied war effort in World War II.
Composed of oxygen, hydrogen, silicon, and assorted metals, asbestos is classified as a mineral. Fibers made of asbestos are durable, flexible and not flammable. Asbestos also insulates very well and doesn't break down easily. Asbestos has been used in older plastics, paper products and floor tiles. Usually, asbestos fibers are joined with a substance that keeps them together, resulting in asbestos containing material, otherwise known as ACM. A range of industrial products are created with ACM, for instance sealants, cement pipe and insulation.
Those Americans worked in the armed forces and had contact with asbestos for a long time unaware of the fact that this could one day bring about the lethal disease: lung cancer.
