SEC. 302. JUDICIAL REVIEW OF AWARD DECISIONS.
- (a) In General- Any claimant adversely affected or aggrieved by a final
decision of the Administrator awarding or denying compensation under title I may
petition for judicial review of such decision. Any petition for review under
this section shall be filed within 90 days of the issuance of a final decision
of the Administrator.
- (b) Exclusive Jurisdiction- A petition for review may only be filed in the
United States Court of Appeals for the circuit in which the claimant resides at
the time of the issuance of the final order.
- (c) Standard of Review- The court shall uphold the decision of the
Administrator unless the court determines, upon review of the record as a whole,
that the decision is not supported by substantial evidence, is contrary to law,
or is not in accordance with procedure required by law.
