SEC. 305. STAYS, EXCLUSIVITY, AND CONSTITUTIONAL REVIEW.
- (a) No Stays- No court may issue a stay of payment by any party into the
Fund pending its final judgment.
- (b) Exclusivity of Review- An action of the Administrator or the Asbestos
Insurers Commission for which review could have been obtained under section 301,
302, or 303 shall not be subject to judicial review in any other
proceeding.
- (c) Constitutional Review-
- (1) IN GENERAL- Notwithstanding any other provision of law, any
interlocutory or final judgment, decree, or order of a Federal court holding
this Act, or any provision or application thereof, unconstitutional shall be
reviewable as a matter of right by direct appeal to the Supreme Court.
- (2) PERIOD FOR FILING APPEAL- Any such appeal shall be filed not more than
30 days after entry of such judgment, decree, or order.
