Medical Criteria
The Act establishes medical criteria that must be met in order for a claimant to be entitled to an award from the Fund.
Similarly objective medical criteria should be established in order for a rail claimant to be entitled to a special FELA adjustment award.
Otherwise, awarding special FELA adjustments will to become a drawn out and contentious process likely to result in awards to unimpaired claimants.
