News on Bayer's YAZ Ad Campaign: FDA and State Attorneys General Reach Settlement over "Misleading" Advertising

In February 2009, the Oregon Attorney General announced his office had reached a settlement with Bayer Corp. regarding the pharmaceutical giant’s ad campaign to promote the oral contraceptive Yaz. The campaign was the subject of investigations with the U.S. Food & Drug Administration (FDA) as well as the attorneys general of 26 other states.
According to FDA warning letters sent to Bayer Corp. in October 2008, television commercials advertising Yaz included information that would lead a consumer to believe the birth control drug could be prescribed to treat PMS, as well as milder pre-menstrual symtoms such as irritability, mood swings and bloating. The campaign also implied that the use of Yaz could reduce menstural-related acne outbreaks. Yaz is not approved by the FDA to treat PMS, acne or other conditions.
