You may be signing away your legal rights to take part in a class action lawsuit.
Since the April 2010 BP oil spill disaster, those who own residential properties, commercial properties or operate one of the countless hotels, resorts, spas or other lodging businesses faced a summer of worry about the effects the BP oil spill would have on their property, their business and their income.
Additionally, the owners, operators and employees of other tourist-driven businesses, including restaurants, music venues and nightclubs also saw significant financial losses caused by the oil spill disaster. Also affected by lost tourist income were recreational equipment rental businesses, retail stores, beachfront food concession operators, souvenir store operators, and the operators of boating, fishing, scuba and snorkeling businesses.
Gulf Coast Compensation Fund Submissions
Our attorneys are working in collaboration with the Florida Restaurant and Lodging Association (FRLA) to assist the owners, operators and employees of restaurants, hotels, resorts and hospitality businesses to seek reimbursement for their Gulf oil spill claims.
While $20 billion has been allocated to help victims of the oil spill, countless claimants have seen long delays in obtaining partial reimbursement, have been paid pennies on the dollar, or had their claims rejected. In addition, claimants who submit "final" reimbursement claims representing long-term losses learn that they are waiving their right to seek legal recourse.
Kenneth Feinberg, the GCCF’s Administrator, had initially stated he would deny business loss reimbursement claims for those who were not located near the Gulf shores, he announced at a September 14, 2010 FLRA meeting that he would now consider these submissions.
The daily news reports of beaches in Florida and other states damaged by the oil spill, tar balls and other environmental pollution led tens of thousands of tourists in both the U.S. and abroad to choose other vacation destinations. The misconception that beaches—even in towns not near the Gulf shores—cost hotels and restaurants hundreds of thousands of dollars in lost business revenue and resulted in their employees losing thousands in summer tip income.
