Strict Liability & Product Liability

Product Liability is a serious issue that can cost lives. Manufacturers of drugs and other products have a responsibility to make sure their products don't hurt you.

If you've suffered an injury because a product didn't work like it was supposed to or was defective, contact Weitz & Luxenburgh by filling out this simple form to see if you qualify for a lawsuit for FREE.

Strict liability is the legal process in which the claim filed by the plaintiff is focused not on the manufacturer’s conduct, but rather the quality of the manufactured product. The basis of the claim is the accusation that the product itself is either defective, of poor quality, poorly constructed, or somehow dangerous or hazardous to the user. A liability claim can attack the product’s design, manufacture, and usage warnings, much like a negligence claim. The different US State governments have a variety of tests that can be brought to bear against a product to check if it defective. These tests range from a broad  concept tests such as consumer expectations of the product, to very specific tests such as the Open and Obvious Danger Rule, which tests how dangerous in the product to the user.

In 1964 The Supreme Court of California was the first to endorse a doctrine of strict liability for products. This doctrine holds that even components manufactures who sell their products separately from the main property, can still be held liable for any defects in the main property.
