Dental malpractice and the perils of root canal
Weitz & Luxenberg is no longer accepting Dental Malpractice Cases
Dental malpractice can occur even during the most common of procedures, including a root canal operation. On May 13, 2008, an Illinois woman filed a medical malpractice suit against her dentist seeking $50,000 in damages for problems she incurred after such an operation.
The complaint, filed in Madison County Circuit Court, charges Godfrey, Illinois-dentist Anna Smith, D.M.D., with failing to finish a root canal procedure, causing the patient to lose the tooth and assume costs for a dental implant. The botched root canal operation was performed July 18, 2006, according to news reports.
The patient, Ruth Dodd, also claims Smith negligently failed to provide proper care and ongoing treatment. The suit says that the loss of the tooth and the need for a dental implant to replace the loss has caused pain and suffering, disability and dental expenses.
The plaintiff is seeking compensation in excess of $50,000, plus legal expenses.
When patients go to dentists, they entrust the health of their teeth to a professional dentist. If that dentist breaches this trust through negligent care or dental malpractice, the patient has every right to seek a legal authority for compensation and damages.
