Accidents from Driving While Distracted in NY and NJ
In light of the investigation into the September 2008 Los Angeles, California Metrolink commuter train crash and preliminary allegations that the train’s engineer may have been text messaging at the time the train ran a stop signal, many states, including New York and New Jersey, are addressing concerns regarding the number of motor vehicle accidents resulting from driving while distracted (DWD) incidents involving a driver’s use of a cell phone.
Several states have banned text-messaging while driving: Alaska, The District of Columbia, Louisiana, Minnesota, New Jersey and Washington state. A bill outlawing texting while driving was approved by the California legislature in August 2008, which is awaiting signature by Governor Schwarzenegger. New York, Ohio, Pennsylvania, Michigan, Massachusetts, Nevada and Delaware all have bills pending that would ban text messaging while operating a motor vehicle.
A survey conducted by the legal information Web site FindLaw.com found that 48 percent of drivers between the ages of 18 and 24 admitted to texting while driving. 27 percent of drivers 25-34 admitted to the unsafe practice, as did 19 percent of those in the 35 to 44-year-old range. A similar study conducted by Nationwide Insurance found that of 1,500 drivers polled, nearly 40 percent of drivers aged 18-30 admitted they have sent text messages while driving.
