Are you in need of a Toxic Tort Attorney in The Ocean State? The U.S. E.P.A. has designated West Kingston Town Dump/Uri Disposal Area in Rhode Island as a Superfund site due to its levels of environmental toxins and threat to the environment. You can read the report for the site below.
Some Superfund sites are on the National Priority Site Lists. The National Priorities List ("NPL") is the list of hazardous waste sites in the United States eligible for long-term remedial action financed under the federal Superfund program. Environmental Protection Agency regulations outline a formal process for assessing hazardous waste sites and placing them on the NPL. The NPL is intended primarily to guide the EPA in determining which sites warrant further investigation.
Sites are listed on the NPL upon completion of Hazard Ranking System (HRS) screening, public solicitation of comments about the proposed site, and after all comments have been addressed. EPA may delete a final NPL site if it determines that no further response is required to protect human health or the environment. Sites where a remediation was completed through the Superfund program are typically deleted from the NPL.
Living near Superfund Sites in Rhode Island may place you and your communtiy at higher risk of getting sick from exposure to the site and experiencing a loss of value for your property, but you can do something to to fight back: The EPA says,
[We have] set up a "Post Construction Completion" (or PCC) strategy to ensure that Superfund response actions provide for the long-term protection of human health and the environment. EPA's Post Construction Completion activities also involve optimizing remedies to increase effectiveness and/or reduce cost without sacrificing long-term protection of human health and the environment.

NPL LISTING HISTORY

Final Date
10/14/1992
Immediate Actions
In 1987, URI removed 159 tons of materials and transported them to federally-approved waste disposal facilities. Additional removal investigations of the site were performed in mid-1992 and the fall of 1993. These investigations indicated that the site did not pose an immediate threat to human health or the environment. Three private wells, located approximately 875 feet west of the site, were closed in 1988 due to contamination and were connected to the URI water supply.
Entire Site
An Remedial Investigation to determine the nature and extent of contamination at the entire site began in 2002. The first phases of soil, groundwater and surface water testing and preliminary design for the closure of the landfill was done in the Spring and Summer of 2003. Additional groundwater testing was done in the Fall of 2004 and 2005. The landfill closure design was completed in 2005. Construction of the landfill caps commenced in the Fall 2005 and is expected to be completed by the Spring 2006.
Enforcement Highlights
In August 2001, EPA and the Rhode Island Department of Environmental Management (RIDEM) entered into an enforcement agreement as a mechanism to implement a potentially responsible party (PRP)-lead remediation at the site. In October, 2001, the State issued a Letter of Responsibility with a Scope of Work to four potentially responsible parties to conduct an RI/FS and implement measures to close the landfill.

Threats and Contaminants
Several volatile organic compounds (VOCs) were detected in private wells near the site in the late 1980s. VOCs have also been detected in the on-site pond. Heavy metals, including lead, were detected in groundwater in on-site monitoring wells. Individuals who ingest contaminated surface water or groundwater may be at risk. Wetlands on-site may be at risk from contaminated surface water.
Cleanup Approach
The site is being addressed in two stages: immediate actions and a long-term remedial phase focusing on cleanup of the entire site.
Response Action Status
| Immediate Actions | In 1987, URI removed 159 tons of materials and transported them to federally-approved waste disposal facilities. Additional removal investigations of the site were performed in mid-1992 and the fall of 1993. These investigations indicated that the site did not pose an immediate threat to human health or the environment. Environmental Progress
The 1987 removal and disposal of materials from the site reduced the immediate health hazards. Three residents, where VOCs were found in residential wells, were connected to the URI public water supply in 1988. Remedial Investigations and landfill cap construction are currently underway at the site.
Current Site Status
A State-lead Remedial Investigation was initiated at the site in the fall of 2002. The data collection and landfill cap construction are currently on-going. Additional groundwater testing was done in the Fall of 2004 and 2005. The landfill closure design was completed in 2005. Construction of the landfill cap commenced in the Fall 2005 and is expected to be completed by the Spring 2006.
