Do I have a CASE? Ask yourself NOW, and KNOW.

FREE False Arrest Case Evaluator! Answer the following three questions and fill out the form below. A legal expert will review your claim within 24 hours.

Question 1: Were you detained in the State of New York?

False arrest, a type of false imprisonment, can occur regardless of who detained you, be it a mall security guard, a shopkeeper or an officer of the law. Just because you were arrested by the police and read your rights does not necessarily make the arrest lawful.

Question 2: Were you imprisoned without reasonable cause in New York State?

False arrest is defined as physically detaining someone without the legal right to do so. You cannot be detained solely because of your race, gender or sexual orientation. You cannot be searched or arrested without a warrant or probable cause to assume you have committed a crime.

Question 3: Did you suffer as a result of your imprisonment?

Only when the arresting party knowingly holds someone who has not committed a crime, is the false arrest itself a crime. However, probable false arrest can be the basis of a lawsuit for damages, including mental distress and embarrassment.

If you answered 'yes' to all of these questions, please fill out our simple False Arrest and False Imprisonment form. A Client Relations Representative will contact you shortly to discuss your potential case. If you didn't answer yes to these questions, but would still like to discuss your potential case, feel free as well to fill out the form below or call us at (800) 476-6070 or email us at clientrelations@weitzlux.com
