On Monday, August 24, 2009, lawyers from Weitz & Luxenberg’s environmental toxic torts group will be in Fennville, MI to meet with families who have been affected by water contamination in the area.
The meeting will be held at Fennville High School, located at 4 Memorial Drive, and will begin at 7:00 p.m.
Our lawyers have been investigating the water pollution problem in Fennville caused by Birds Eye. The factory, which produces fruit products, had been taking dreg materials left over from fruit-processing and spraying the dreg material in fields in the Fennville area. The spray caused serious changes in the chemical make-up of water in the area. Not only were oxygen levels in the water decreased, but arsenic, iron and manganese levels increased to unsafe levels.
“The water contamination in Fennville has caused significant hardship to those living in the area,” said Robin Greenwald, head of the Environmental Torts unit at Weitz & Luxenberg. “In addition to threatening the health of Fennville families, the contamination has devalued property so that people aren’t able to enjoy or to sell their homes.”
Our lawyers will be providing more information about the firm's investigation and will answer questions from Fennville families about their rights to file a lawsuit to seek compensation from Birds Eye for any adverse health effects they have suffered because of the tainted water, as well as for financial losses for decreases in their property values or damage to other property that has been damaged by the contaminated water.
“I have visited and spoken with Fennville residents about what they must contend with every day due to the tainted water,” said consumer advocate Erin Brockovich, who has joined forces with Weitz & Luxenberg to help the community. “While Birds Eye has provided bottled water to some residents, it’s a short-term Band-Aid solution to a long-standing environmental problem,” she added.
Our Lawyers
Our environmental attorneys are litigators with extensive courtroom experience and an in-depth understanding of the environmental laws.
Weitz & Luxenberg is currently litigating two large cases involving injuries people have sustained as a result of exposures to contaminants in their drinking water and/or in the air they breathe: one in Plant City, Florida, which has approximately 1,000 plaintiffs, and one in Grand Island, Nebraska, which has approximately 300 plaintiffs.
Our Success
The firm recently secured a landmark settlement against some of the country's biggest oil companies for contaminating public drinking water supplies with a gasoline additive known as methyl butyl tertiary ether, or MTBE. Most of those defendants agreed to pay $423 million to settle suits involving the contamination of 153 public and private drinking water systems nationally.
