July 2010 Oil Spill May Cause Environmental Damage in Kalamazoo River and Talmadge Creek Region

The lawyers in Weitz & Luxenberg’s environmental litigation unit are currently investigating potential property and business loss claims stemming from the Kalamazoo River spill.

Residents and business owners in the region can obtain news and other vital information about their legal rights to seek compensation from Enbridge Energy for their property or business loss damages by completing the form on this page.

IMPORTANT: If your livelihood, property or health has been affected by the Kalamazoo oil spill, we urge you to seek the advice of a lawyer before signing any documents relating to your injuries or property damages. You may be signing away your legal rights to seek compensation for oil-spill related lawsuit damages.

On July 26, 2010, residents in the Kalamazoo, Michigan region found themselves facing environmental disaster after an oil pipeline owned by Canadian energy company Enbridge Energy Partners LLP burst.

The resulting break in a 30-inch pipeline in nearby Marshall has caused an estimated 1 million gallons of crude oil to spill into Talmadge Creek, which feeds into the Kalamazoo River.

The Kalamazoo River oil spill site area is located between Marshall and Battle Creek, and includes residential areas, farmlands, marshlands and businesses.

Environmental Investigation
Immediately after the oil pipeline burst, the U.S. Environmental Protection Agency (EPA) began an investigation into the Michigan oil spill, its cleanup and containment.  They are also reviewing data about potential environmental and health implications for families living in the area, as well as potential harm to marine and wildlife native to the Kalamazoo River region.

The EPA has undertaken air monitoring of levels of benzene and other volatile organic compound (VOC) emissions caused by the spill, and will be providing updates to Kalamazoo area residents of any potential health risks.
