Parties settle before trial in Illinois medical malpractice head injury case
October 16, 2008 -- The parties in a head injury malpractice lawsuit against an Illinois doctor and hospital have settled, averting a trial in Madison County Circuit Court.
The plaintiff filed the suit on behalf of her son, alleging the doctor and the hospital failed to properly diagnose his head injury. Terms of the settlement were not disclosed.
The suit, filed in January 2006, alleged the hospital failed to perform diagnostic tests that would have shown a head injury upon his initial admission, failed to discharge him with adequate instructions, and failed to timely diagnose his true injuries.
The patient’s mother charged in her lawsuit that her son sustained severe and irreparable brain damage as a result of the negligence, and is confined to a wheelchair.
