New York state supreme court quadruples $5-million jury award in medical malpractice case against Buffalo hospital
August 13, 2008 – A New York Supreme Court justice last week increased to $19.5 million the malpractice award a Buffalo jury recently ordered Kaleida Health to pay an Olean businessman who was left permanently paralyzed after a massive stroke.
The malpractice lawsuit accused doctors at Millard Fillmore Suburban Hospital of failing to diagnose what it called "classic" brain aneurysm symptoms that led to a debilitating stroke.
The court found that the jury’s $5 million award to the injured patient “deviates materially from what would be fair compensation,” and cited “the devastating effect the stroke has had” on the 52-year-old former excavation contractor and his wife.
