New York governor approves doctor misconduct law

August 13, 2008 – New York Gov. David A. Paterson last week signed into law a bill that will make medical malpractice records more transparent to the public.

Under the new legislation, physicians charged with misconduct can now be publicly identified and the state Department of Health will have new powers to investigate medical wrongdoing.

Legislators said the law was prompted by the case of a Long Island physician whom the Department of Health accused of reusing syringes and infecting at least one patient with hepatitis in 2004, but who failed to alert the general public as required.

The new law expands the state’s reach into private medical offices, and gives health authorities a freer hand to communicate with the public.
