Family of brain injury baby awarded $4.4 million
Nurse failed to diagnose signs of fetal distress in brain injury baby malpractice case.
February 18, 2009 – The parents of a baby girl who died five years after suffering from a brain injury during her birth have been awarded $4.4 million.
The infant was born on November 18, 2003 in Piedmont Medical Center, South Carolina. The parents’ medical malpractice lawsuit claimed that their daughter was born with brain damage and had later developed cerebral palsy due to a lack of oxygen at her birth.
Court documents revealed that a nurse failed to diagnose signs of fetal distress, which required emergency intervention.
Both the hospital and staff were named as being responsible for the child’s injuries in the medical malpractice lawsuit.
