Jury awards West Virginia widow $1.54M after husband’s heart defibrillator mishap
September 22, 2008 -- A West Virginia jury last month awarded a Barboursville woman $1.54 million in a medical malpractice lawsuit. She sued after a common surgical procedure involving her husband's heart defibrillator left him with severe brain damage.
The doctor involved was cleared of all wrongdoing, but a nursing anesthetist was faulted for inadequate attention to the man’s vital signs.
Heart defibrillator malpractice lawsuit
The jury found that as surgeons were installing an automatic implantable cardiovascular defibrillator, the anesthesia team failed to notice that the patient’s vitals were deteriorating. The man’s brain was deprived of oxygen for a considerable period of time because of a lack of breathing. This resulted in severe brain damage. The man eventually died.
