Spokane jury awards $14.8 million to woman in dental malpractice verdict
August 28, 2008 – Medical malpractice news bulletin: A Spokane County Superior Court jury awarded a woman $14.8 million in a dental malpractice lawsuit that was decided two days ago. The verdict is one of the largest dental malpractice awards on record.
The woman, 29, a former Lewis and Clark High School cheerleader and varsity tennis player, is permanently disabled and in chronic pain. She cannot work and is being cared for by her parents, according to the suit.
After injuring her jaw in a sledding accident, she went to the dentist who, she said, told her that he had a near-perfect success rate with a surgery technique he had developed. The operation reportedly left her disabled with her jaw fused shut.
The jury decided that the oral surgeon was negligent in performing the operation. The $14.8 million verdict – considered one of the largest awards for dental malpractice – includes $10 million for non-economic damages that include pain and suffering.
